Visa availability and approvals

Ok...lets look at some numbers:
USCIS declared on July 2nd that all available visas were consumed.
Assume that 40,000 Visas were ‘really’ made available in June by the state dept (they mentioned 60,000 in revised bulletin but I don’t believe that!).
USCIS Work days in June = 21 days
Average approvals per day = 40000/21 = 1905 cases/day
Rate of approval w/8 hours of work day: 1905/8 = 239 cases/ hour

Hard to believe, but do you guys really think that USCIS was approving 239 cases/hr last month (unless they have 50 officers dedicated to approving ‘just the 485s’ and were approving at the rate of about 5 applications/officer/hour Non-stop  )?

If this is unrealistic and if the theory that they might have ‘pre-assigned’ the visa numbers to the cases is true then we should continue to see flood of approvals in July! Shouldn’t we?

Unfortunately, I did not see any new approvals posted here yesterday! (I would consider one or two approvals as exceptions) Hope that they have not ‘really’ consumed all the available visas. Shall we still be hopeful to see any flood of approvals or they are done?…..Any thoughts?

Good analogy Leo!
Thats exactly what I was thinking too.
Attorney SheelaMurthy in her weekly Monday Night chat lastnight also said that"its hard to belive that USCIS approved over 40,000 cases in 1 month, since whole of last year they approved 10,000 cases per month".

SO lets hope they "pre-assigned" the visa numbers to the exisiting eligible I-485's and are waiting in an "staging area/pipeline" for a officer to bless them.

This is really getting frustrating.

GL to all

Looks like some of us are going to be approved this month :D according to the above theory . The closure of all EB category for the FY 2007 might be for I-485 filling so that they do not loose the extra fees which is going to be in effect from August 1st , but closing all the EB category might be the only option left for USCIS.

Lets wait for some more approvals this month............:D :D :D :D

The "fee conspiracy theory" doesn't make sense .... Since the new fees include the cost of EAD/AP, USCIS would gain a lot more if they accept the cases now and milk them later for EAD/AP renewals (at the new rate which is $300+ if I remember correctly !)

So its definitely not the fee :D

according to the previous conversation with NSC which are posted by some memebers before..they are trying to finish up all the pending cases within next 120 days..so according to the above theory if 20k visas have already been alotted to another 20k pending applications then according to NSC schedule we will be seeing more and more approvals in coming months :)

Visa Numbers

I think it has something to do with the fact that the new immigration bill failed.
USICS was anticipating it to pass and hence trying to clear the backlog.
If this bill had passed, the employement based visa numbers would have gone up. I noticed that most of the approvals happened during the period when this bill was being debated in the congress.
If this bill were to be passed, the USCIS would have had to deal with the legalization of the millions of illegals, which means a heck of a lot work load.
Hence, the need to clear the backlog.
Anyways, I thinkg the USCIS is doing its best given the limitations from the Government and the immigration law. Remember, their primary task isn't just to give people Green Cards and Citizenship, but also to protect their borders.
Its all good, I am sure we all will get our GC's. Its just a matter of time so my friends, sit back and go on with your life.

I am fed up with this system . Each time USCIS brings a new rule from its hat and trying to see what comes next.
In my ten years I have 8 H1b's , 4 Ead's - applying for 5th,3 ap's,4 Fp's (1,2,3) and ton's of money .
First labor was delayed, next retro and now Eb's closed for FY 2007 . Planning to R2I if nothing turns up till this year end.

Good luck.

do you guys think work load due to rejection of new applications :( might be a reason for them to delay the pending cases processing??

I thing different people handle initial check (reject :) ) and adjudicating cases.

I am in dilemma as i am from World wide category and of EB2 classification. Now my dates were current in June bulletin. After revision of July bulletin. Can i file for my 140/485/EAD/AP.Any inputs?

All EB categories are unavailable now. You can file I-140, but have to wait for your country being current in DOS visa bulletin to file I-485/EAD/AP.
