Visa appointment at Mumbai by VFS site while H1 extension application is in process.

Hi

1)I am planning to go to India in Jan 2007.
I am completing my 6 years in Jan 21 , 2007.

My attorney is yet to apply for the 7th yr H1 extension .
I think if I apply next week , I will get my 7th year extension in November/December.
Assuming that , my question is :-
Can I go to vfs website and book an appointment for Jan or should I have the renewed H1 for booking an appointment in VFS website.

(Do VFS website asks for details about h1 approval? )

My idea is to get my visa stamp till end of 7th year extension ( which i am appying now and assuming will get in Nov/dec).

2) My employer filed labour certification for green card.

In visa application form DS -156 , what should I write in clause 36.

Has anyone filed an immigrant visa petition on your behalf? yes or No ?

I am not an expert, and nor much experienced. But I have heard about similar instances.

1) For appointment, VFS will ask the EAC mentioned on I797 approval notice. When my employer filed for my H1, we got the receipt, which had the EAC number. I have used that EAC # to book appointment. You can put a tentative expiry date (which would be 1 year from the approval date, in your case).

2) You say "Yes" and give details if necessary about who has filed for immigration visa petition on your behalf. Also, do take a proof of Green Card filing. Your lawyer should have some kind of letter from USCIS mentioning that they have received an immigration petition on your behalf. Carry any document related to your non-immigrant as well as immigrant visa petitions. You never know what they might ask for.

Sorry for my ignorance in the previous reply.

For 2nd question, if your GC processing is still in 1st Stage (Labor stage), then you write "No" for immigration petition. Only if you are at or beyond 2nd stage of GC, then you say "Yes" for some one having filed immigration petition on your behalf.

Please confirm this with some one else too.
