last week i received an RFE from CIS requesting the following:

1- my divorce decree from my ex-wife.
2-marriage certificate to my current wife and a proof that me and her reside in the same household together.
3- 2004 income tax return.

with the RFE they enclosed a golden paper with the officer number and my file # on it. and it says: please put this golden paper on top of the requested paperwork to ensure the timely handling and mail it to TSC.

2 weeks before i received the RFE i had written to my senator for help to request an emergencey permission or to speed up my case to go back home to see my ill mother.

after i sent my RFE to the CIS and they recieved it, i received a letter from the senator telling me that he already talked to the CIS about my case and he will let me know when they respond to him.
now, do you guys think the CIS sent me this RFE in response to the senator and they are working on my case now?? and why did they ask for these papers??? i'm an asylee applying through asylum not through marriage.
and why are they asking about my income tax return??? as far as i remember it's optional. any thoughts???

God have mercey

so wait for good news.at least officer who works on your case knows he will lose his job if senator calls next time ;) they might give you something like advance parole to vizit home country. friend of mine was illegal here his granfather died and His future wife US citizen got permission from USCIS to vizit his home.but they stated that they are going to get married after his return ;)

Hmm, it is a tad weird that they ask for tax returns at this stage of the process. Not that they don't have a right to; they can ask for pretty much anything they want, but I had never heard of a request for tax return proof while approving an asylee for a GC. I know they ask when you apply for citizenship but you are the first one I heard who was asked for tax return for I-485 approval as an asylee. Anyhoo, since you sent them everything they asked for, just sit back and wait patiently but positively.

i enclosed my tax returns while i was adjusting my status. i think it is normal procedures.

maybe they asked for my 2004 tax return because i mentioned that i have my own business and they wanted to varify that???

I know it is not asked when applying for GC; I even recently checked the recent requirements to see if there was any change since when I applied ,and tax returns was not listed. But I did show my last two pay stubs when I was applying for the asylum; that I remember.

I dont know my lawyer requested my tax return from 2004and 2003 before sending all that paperwork for adjustment status

what drives me crazy is why they are requesting divorce decree to ex- wife and marriage certificate to my current wife and proof that we both live together??????

Maybe, the IO got confused and though u apply based on marriage. :D

Did u send marriage certificate with your original application?

Why is it driving you crazy? why do you feel they are doing this? are you worried that there is a mixup? are you worried that they did not believe something you said in the forms and you wish you knew it so that you would send even more stuff as proof? what is precisely worrying you? I think you sent them what you were asked , so just relax and sit back. They will not deny your application for lack of proof as you keep on providing them evidence. So let them ask whatever they feel they need to ask and just know that you did everything by the book.

CL_asylee please give me a break...the officer knows darn well i'm an asylee. and no i didn't send marriage certificate with the original app.

Clotty is right.

Asylee01, why r u getting worried bro,.... Tax returns are simply a proof of your physical presence in US.. may be he wanted to find out that how come you got that late to apply for AOS. For rest of the docs.... these are so minor documents which have been requested from you.... you should actually be happy that your RFE was such a simple.....ask other people who had to spend months to get their RFE documents together ...

All the best...

Take it easy. Send them the goddamn papers they requested - at least they are doing something. The bottom line is your case is moving along. It took them 4 months to figure out that they need to process my case nunc pro tunc. Duh... Morons!
