very very urgent . Please help me - IEAD issue

Hi,
Here are the details of my EAD renewal. Please give me advice immediately.

I-485 rd (12/26/01)
EAD issued on (04/06/02)
EAD expires on (04/07/03)
EAD renewal notice date - 01/16/03

My Employment will be terminated if I can not show the IEAD by end of 04/10/03.

Last week I went to Santa Ana local INS to get my Interim EAD
but the officer told me that he would issue IEAD only after 90 days from the receipt date which would be on 04/16/03.

My Employer (one of the Top 100 fortune companies - Telecommunications) has very rigid principles. They are giving me only 72 hours from the date of EAD expiry (which would be 04/07/03 + 72 hours = 04/10/03).

If I can not show the proof of IEAD by end of 04/10/03 my employment will be terminated.

I would like to go to any local INS office (sand diego, San Francisco or Los Angeles office) which ever accepts my request.

Please give me advice. If any body has faced this probem please let me know immeditely.

Couple of options that u may want to try

1. Tell yr employer that you will take medical leave between the 2 dates where you will be out of status. During medical leave an employer cannot terminate you, so take leave, go get theIEAD and then present it to your firm.

2. I would suggest a more professional approach, go to the law offices of sheela murthy, the best lawyer in the field of immigration who will give you the best possible advice, in your case I think you would be charged about 100-150$. But the advice would be sound, www.murthy.com

You can renew the existing expiring EAD at local office may be Santa Ana for you, this is a fresh application nothing to to do with the one u applied earlier. So u need to pay fees $120 again to renew this and I guess it was on same day before, but now they are doing it next day since IBIS check or whatever.

I would try this route immediately and go to INS for a couple of days and pay $120 more try to renew it.

I know people who did this before in Denver office.

But if you are working with the same employer then why do you need iEAD to continue your job?

I have learnt from this board only that (I think it was from murthy.com chat abstract) you don't need iEAD to continue your job for that same employer yes if you are changing job then it is required.

Show the rule from INS to your employer.
Or as RM suggested go to local INS try to get EAD, but I am not sure if they can give you EAD in a day or two.
Take few medical leaves form 04/04/03 to 04/18/03 so that your employer can not fire you and meanwhile you can get iEAD on 17th. But I guess your termination letter will get ready on 04/10/03 even if you don't show up on that day. So try to convince them it is a matter of 7 days only.
