There is a possibility of layoff in my company. My fingure printing was completed in last week of Nov 2004. My priority date is Sept 13 2001.

I140/I485 joint jan 7 2004. I140 has been approved.

I am expecting I485 approval in next 3 months time as per the approval trend now.

Since I am so close to approval I dont want to take the headache of changing job and utilizing AC21 ( also job market in my area is very dull at this time).

In the worst case scenario if I get laid of before my I485 is approved will the I485 petition become void?

I am in a great deal of stress. Please give some input. This never ending wait for GC will probably destroy my heart.
 
No. If you get laid off then look for a job and if required ( i.e. if you get an RFE ) use AC21. You should proactively look for job if you are sure of your lay off !

Since your I-140 is approved, and I-485 is pending for more than 6 months, you are covered under AC21. Only thing is if there is any RFE regarding employement status, you will have to provide some sort of support letter from the new employer so I would suggest, start looking for one. But if you are lucky enough, your case will be approved without any RFE.

You can just stay at home until your I-485 is approved, provided 1. You dont get any employment RFE 2. You dont get called for an interview where the officer might ask you about your employment. I know people who didnt have a job for more than 6 months, got approved without any issues. But the safer recourse for you would be to start looking for a job immediately and invoke AC21.

Boss, try to find a job in the same or similar field. You could get unlucky and receive RFE for EVL, last 2 months pay stubs etc. There are folks in this forun who have received such RFEs.

Remember you are on the edge of approval. Do not take any chances. At this moment it is always safe to have job than nothing. Good luck
 
I will say better wait for layoff and then look for another job. There is no problem using AC21..many people got approved AC21 and no RFE. I have one of my close friend approved too.
