VERY URGENT regarding I-824

After filing my I-140 at CSC when I was in California, I have moved to the East and now I fall under Vermont Service Center.

After the above move,my I-140 was approved wherein I had opted for Consular Processing at Mumbai.

But the case file is yet to reach NVC.

My attorney has suggested that we could file I-824 (for having the case file moved to NVC from CSC).After we obtain the Receipt Notice for this I-824,we can go through AC-140 at Mumbai Consulate.

I have to very urgently go to India for perhaps about a month.Instead of going to the Consulate for my H1B stamping,I was hoping I could go for AC-140 and get over this GC thing.Else, I will have to get H1B stamped now and again in a few months' time, I would have to go back to India for my GC interview.

Questions:

1.If I file I-824 now, WHICH service center should it be filed at? - CSC or VSC?

2.If I file it at CSC, is there any chance that it might be forwarded to VSC?

3.How long does it normally take to obtain the Receipt Notice of the I-824?


I would also request to please post your opinions as to what I should do:-

A. Forget about I-824 / AC-140 now, go to India for my purpose, get the H1B stamped, return to US and go back for GC interview later on whenever it comes?

OR

B. File I-824, wait till we obtain its Receipt Notice, do all paper work for AC-140 and then leave for India. My attorney could then do all the procedure for AC-140 and send me the papers to India.

Would it be possible in this case, that I could possibly be interviewed at Mumbai while I am there? Or would the Consulate still make me wait in line for another 2-3 months for them to schedule the interview? In which case, I cannot go this route.I can stay there for maximum about 1 or 1.5 months.

Sorry for such a long and confusing post, but cant help it.
 
I hope your ETA 750 (Labour Application)Column 7 has various unanticipated locations. Since it is a future job, it should not matter - I would think it is better to continue with same service center.
 
The instrcutions on the I-824 clearly suggest that it must be filled with the CSC, the centre which originally approved your I-140.
 
Ac 140

Be carefull the Mumbai consulate is taking a long time to give interview dates for AC 140 cases. I have been waiting since Dec for a date no signs of one yet.
 
Can someone tell me who files the I-824? Beneficiary or the attorney? Also, what do you fill in Part 3, #2, Current/Most recent immigration status (Information about the applicant or petitioner). Thanks in advance.
