Very Urgent: H1 revalidation problems in Mumbai

I need some urgent advise/help from the folks out there.
I am going to Mumbai next week and I would have to get my visa re-stamped on my passport. My passport has a expired visa, and I hadn't got my passport re-validated in US. More than a year has passed, so I can't get it revalidated in US and hence, would have to go to US consulate in Mumbai for that.

My question is :
Would the US consulate folks give me a hard time for not
re-validating my visa in US after I changed my company?

I had also visited India a couple of years back, but, my, then H1 visa was still valid on my passport and hence, didnt revalidate it.
Would the US consulate create problems on these grounds?

And the general question is, has anyone encountered any problems during visa-restamping in US consulated in India ?

Please advise or post a reply to this message. Any kind of information would be helpful.

No you should not get any hard time.
Technically you donot need the visa restamped as long as you have a valid I-94.

I have had visa's issued in Mumbai Consulate and never had any problems.

I had an F-1 stamped through mumbai and 2 subsequent H-1's no issues at all

If my visa has expired on my passport, I would still need it re-stamp a visa based on my current h1, correct? I have a valid I-94 attached with my h1, but when i return back to US, wouldn't they want to see a valid visa ?

You have to have a valid visa to enter US. For that you have to get a new visa stamp in Mumbai, since your visa has expired.
They will issue a new I-94 when you enter US.

You will turn-in the I-94 to the airline at the point of exit.

Since the visa is expired, U don't have an option but to get a new stamp on the pp.

I am aware that I have to get it stamped. There is no second thought about that.
Let me put some dates here, to put things in perspective.

March 2000 - Visa stamped on passport of company A, entered US for the first time on H1.

November 2000- Transfered H1 to company B.

April 2001 -Visited India , didnt re-stamp visa for company B as visa of company A was still valid.

May 2001- Entered US on visa based on company A, but got I-94 for company B, by showing h1 documents and recent paystubs.

December 2001 - Transfered H1 to company C.

September 2002 - Visa expired of company A.

December 2002 - Came back to company B. Company C H1 visa cancelled.

January 2004 - H1 visa of company B renewed successfully.

I know it is a bit complicated with all these company changes and therein lies my concern.
What kind of problems do u'll forsee due to the following concern related to my visa/passport:

1.My passport has an expired visa and I have changed 2 companies since and their visas are not stamped on my passport (simply because the older visa had not expired and I didnt get around re-validating the visa after the old one expired). I had valid H1's throughout the time period.
2. Would they question why I didnt get the visa re-validated after it expired more than a year ago?
3. I had been to India before the expiration of the visa stamped on my passport. I entered US on the same visa but the I-94 has the name of the second company (they scribbled it on the back).

Help me guys !

1. I doubt they would have validated your new visa unless your old one expires -- The visa renewal site clearly mentions that they will not renew visa's which have not expired, and I believe they also mention about the change in company situation not needing new visa till the current one expires.

2. Visa is required to enter US, not to remain in the US : I-94 decides your stay.

3. Visa issuance will be looking at current documents and if you are eligible to get a visa (which you are based on approved H1 paper)

Yeah, I agree they wouldnt have validated the new visa as the old hadn't expired. Would they raise concern that I didnt validate the visa after it expired ? My visa stamped on my passport has expired for more than a year. Would they question why I didnt start the renewal process when my old visa was expiring?

Relax dude, as long as you maintained Legal Status all along, had H1 and got paid as per the lca( I know chennai give hell about this), there should be no issues, Visa is requied only to go and come into US

I had another question:

I work in New York. my company (which holds my h1) is based in NJ and my H1 renewal LCA mentions NJ as the work place.
Would it create a problem if the US consulate guy asks where do u currently work and if I say NY, but my LCA says NJ? Or do I have to say NJ, when asked such a question?
