Very Simple Tax Question..

My husband is GC holder and has RE permit. Due to child illness and his father's death, we have not had time to prepare our taxes yet or at least with out rushing like fools. If we file for an extension, is he considered 'late' when he goes to apply to become a citizen should he go that route in the future??

I believe the extension is Oct 2011...

Thanks..I told you this is a simple question:) I think the answer is it is ok to file by OCT since we would have the legal extension...
 
If the extension request is filed before the April deadline, and the return itself is filed by the October deadline, it wouldn't be considered late.
 
However, note that if any money is owed after the April deadline, the payment of it would be considered late (and penalties and interest will be assessed), even though the extension request was filed on time. Remember they expect you to estimate the amount owed (if any) and send payment with the extension request.

One time I slightly underestimated the amount when I filed for an extension, and ended up having to a pay a penalty of something like $10 :eek:. It probably cost them more to send the penalty notice and process the check than the penalty amount!

yes I learned that lesson myself as well a few years ago..mine was for more than $10 though...maybe a few hundred!

On a good note, in the country where I get paid from, the tax date was MArch 15..so I pretty much made sure I got that in on time...so with no double taxation clauses, I think I estimated that...but who knows..

I don't think I can get it all together to the acct before the deadline..so if it is owed will have to pay /suffer consequence...I think/hope we will be ok though..

I also have one simple question. If you don't owe any money to the IRS, can you just file the return late?

Can I for example file return for year, say, 2009 ?
