Hi Seniors and friends

I got perm Job with Master Card But salary diff is $12,000 and My 485 pending for 18 months with consulting firm . Everything else is same except salary is so much differnce Do you think it will pose any problem in case of if use AC21 as this is very good chance for my life... ? and how far Salary is going to play a role in in AC21 cases

I do not think 12K difference should be a problem, as long as you have the same/similar job title and job description.

I understand the salary and position has to be same? However I must aggree this is very important issue.

Similar is the operative word. Job resposibilities have more weightage than salary. If there is a change in location they make concessions for that. If you made $90k in New York they may not make an issue of new employer paying only $60k in S.Dakota.
Also, drop of 12k from $90k is inginificant, not so from $50k.

I agree with the view that a drop of 12K is insignificant .Also what salary are u comparing this with ... Is it the salary on the labor that u are comparing it with.

Now i want to point out one more thing...... we really (i mean all of us) are not in the best position to decide what AC21 means ,,, we interpret it how we read it ... Thats why I feel its very important to discuss with a lawyer. e.g i work in oracle and i was talking to a lawyer she said as long as i work in a related field like SAP ,People soft etc i am fine ..... what i am trying to say is that sometimes we take unnecessary tension and concerns. now that is ok to some extend but we just cross the limit. then we ask people around even they dont know .... they tell us what they know and the process multiplies .... and the irony is that we think all of us here know more than the lawyers......

what i am trying to say is ... dont interpret the law urself take the help of a lawyer and trust that .....

Thanks all.. I think some times lawyer is good Bet.. I agree Which i'm going to do..

But Actual recent exp of people reflect exactly what's going on...
 
Lesser salary shouldn't be a problem

As per my lawyer, lesser salary shouldn't be a problem. But your job description should be same, a little change in the technologies currently using as compared to one that you had shown while procuring your labor certification is acceptable. If there is a change in the Job title, then you need to get a letter form you current employer to prove that the job description remains the same but with a different title.


OR get a letter with a title like this -
System Analyst/Programmer Analyst
- assuming your LC says - Programmer Analyst
and current Title - System Analyst

- Flam
