I do not understand why our office in Chennai declined to issue you with a Direct Airside Transit visa. It does not appear that she qualifies under one of the exempt categories, eg as the holder of a valid US residence permit or visa, since the documentation she possesses does not constitute either. Unless there are factors to be taken into consideration of which I am unaware, in our view she needs a Direct Airside Transit visa - and may therefore experience difficulty boarding an aircraft to the UK without it.

I can only imagine that whoever looked at your wife's application in Chennai erroneously believed that she could benefit from the concession referred to below. However, as your wife did not travel out to India via the UK, the concession does not apply.

I am copying this message to the Entry Clearance Manager in Chennai.


The terms of the concession referred to above are as follows:

Until 23:59 hours BST on 12 November 2003, nationals of:

Angola
Bangladesh
Cameroon
India
Lebanon
Pakistan

on the return leg of their journey may transit the UK without a visa provided that;

- They originally passed through the UK in transit (with or without a visa) on the outward leg of their journey; and

- They started their outward journey from their point of origin on or before 15 October 2003; and

- They arrive in the UK by air with confirmed onward booking by air within 24 hours of their scheduled arrival; and

- They have the necessary documentation, such as a genuine valid visa for their destination.

MY EMAIL TO THE CONSULATE:-

RESPECTED IMMIGRATION OFFICER,

I and my wife are in USA from past 5 yrs as a non-immigrant resident. I heard from my wife as of Oct 21st 2003, when she submitted the Passport for DAT VISA at the INDIAN British Consulate at Chennai Via Visa Application Centre at BANGALORE for traveling to USA on NOV 1st 2003 Via LONDON by AIRINDIA, The INDIAN British Consulate at Chennai refused to stamp my wife's INDIAN Passport with DAT VISA stating that all the passengers with Advance Parole from USA does not require any Transit VISA at Heathrow Airport (If they are staying at the Airport for Less than an Hour and if don't need to do immigration check). As of Oct 22nd 2003 all the documents have been returned back to her without VISA stamping from BRITISH CONSULATE. Now she has her scheduled trip to USA via LONDON on NOV 1st.

FYI, please note that Advance Parole (AP) is a Legal document given by US Immigration an ORGANISATION called BICS/INS which must be used for traveling purposes only while in Adjustment of Status (Green Card). AP does not have a Stamping on the passport Unlike H1/H4/VISITOR/L1/B1 VISA etc in US.

Questions:-
What would happen to my wife, whose passport is not being stamped with DAT Visa, as per Chennai?s INDIAN BRITISH CONSULATE HIGH COMMISSION INSTRUCTIONS, Also she is holding a valid Advance Parole from US with confirmed returned tickets booked from USA on August 2003 and would be traveling in NOVEMBER 1st 2003 Via BOMBAY - LONDON ? CHICAGO,USA? Note: My wife did not travel Via LONDON when we traveled to INDIA from USA. Her routes were USA-PARIS-INDIA.


Considering the confusions above: -
· Would the UK Immigration consider in allowing the my wife to transit Via LONDON Even though the British Immigration Consulate at Chennai did not stamp her passport with DAT VISA considering that she has a legal Permit to travel using an Advance Parole from USA Via LONDON.

· Or what are all the options at that point even thought the passport was sent for stamping and was not stamped?
· Or With all the valid and legal documents of the US, the Passengers will be allowed to move on to their respective destinations without hassles?

· If the passenger proves that he/she is in the US with all the Legal status, Legal address, Valid State Driving License, Original and Genuine Immigration documents from US and that they don?t want to stay or have intension of staying in UK while they are in TRANSIT via LONDON. Is this Fine to Travel Via LONDON

I am also in the same boat. My wife was refused visa at chennai UK council. Is your wife planning to go back to get the visa. ?Please post the follow ups. It will be very helpful to me and others.

I am asking the travel agent who booked the Flight Via LONDON to change via Paris. Ramesh, this DAT VISA is a serious Issue . I just happened to speak with BOMBAY UK cosulate at 912222832020 asking about the AP documents and DAT VISA. They re-confirmed we need a DAT VISA if AP otherwise the passenger will have difficulty to board the AIRINDIA Flight at BOMBAY.

Then why the hell Chennai UK embassy refusing to issue Transit Visa. Required or not, what are they going to lose if they issue transit visa even if one not required? We are paying the fee and everything?
 
Guys,

I would say avoid going thru UK if you don't want any kind of tensions (like spending $67 or sending your original docs).

More over I don't understand one thing why people are so keen on going by Air India?

My wife and daughter went by Air India in March this year and had the worst experience (personal dealing of crew members and bad behaviour). She told me after coming back that she is not going again by Air India in her life.

Atlast, Yesterday my wife (who travels on AP) was told at chennai consulate that she needs transit visa.

After sending the complaint emails many times to Chennai (UK Consulate) and CCing to British Consulate (UK Consulate). Now they started to process huh (For god sake Finally).

FYI,
Ramesh, Yesterday, my wife went to pick the courier, which was sent back from CHENNAI. My wife showed the Email Letter replied by UK Immigration (LONDON) to the Bangalore VISA Application center, the Bangalore VISA Center has once again accepted her application. Hope the Chennai UK Immigration people will stamp DAT VISA without any problems. I am very much tensed that She has a flight to catch on Nov 1st at 10 PM from Bangalore, and its a very close call. (Anyhow for the heck of a sake, I have told my wife to block a ticket via PARIS from BANGALORE to WASHINGTON DULLES for the same day).

Today my wife got her DATV visa instantaneously at chennai consulate. It took just couple of hours. Hope your wife would have got visa by this time.
