Very Confused - June 30th dealine & Medical Examination? Experts Please Help!

Hello All,

I am very confused about couple of issues. My I-485 and I-140 were concurrently filed in March 2005 (labour substitution case). I got my medical done last year in November 2004. I got married recently (in May 2005), got my wife here on spouse visa, and have file for my wife's I-485 (without the medical) on June 30th. I got her medical done recently. I am confused about the following -
1) I filed my I-485 with medical paperwork but have filed for my wife I-485 without medical because of June 30th deadline - is it going to delay my process? Is it fine for me if I file her medicals after couple of weeks?
2) For MMR and Varicella 2 Doses of Vaccinations are required - I submitted my medical paperwork after taking only Dose one. Forgot about the Dose 2 - Should I go for Dose 2? Is it required? Also will I have to get all the medical reports again from the doctor? Sam thing for my wife - I got her medical done yesterday - She has received Dose 1 and Dose 2 is not due until next 2 months - so can I submit her medical reports without Dose 2 and what should be done once Dose 2 is taken?
3) I am very confused about the June 30th deadline - I managed to submit the paperwork for my wife (without the medical) on June 29th (via Fedex Deliver Overnight) - but I do know how this works. The INS should have received the package next day - June 30th. Now I am waiting to get the receipt notices from INS for I-485 for my wife - What if the receipt notice have a date after June 30th?
4) Also is June 30th deadline applicable in my case scenario? - as I am labor substitution case (in EB3 category) with concurrent filing. And my wife (who is here on spouse visa) is dependent on me. Please suggest.

It's always wise to have all necessary shots. Whatever the doc. filled out on the I-693 is what the USCIS will use to see if you need to do nyhting else as far as shots and tests. Yes, the concurrent filing situation applies to you, being EB-3. I think you did the right thing to submit the paper work prior to July 1. This way, the USCIS received the application beforer that "magic" date, so it's now up to them if they are satisfied or will issue you any RFE. My understanding is that as long as the USCIS has the official application on file, you can always complement it with additional evidence and still maintain the very same priority date. As far as receipt date, I have heard 2 versions: that the official receipt date is when the USCIS opens and stamps the application, which usually is about one week ater hey receive it, and another version is that the date is when the application arrives in their office. I don't know which one is the correct version. I do know that for H-1B applications, the receipt date is when they officially open and stamp the application, usually a week following the arrival at their office. Regardles, you did the right thing by getting it in the mail before July 1. At least now you have a shot at a june priority date.

I am still waiting to get the receipt notices from the INS - I will get them probably sometime next week. But now I am very worried about this one week lag - because if the receipt notices specify that the receipt date is July 7th instead of June 30th (which is the date when they actually received it as per FedEx tracking) than I am screwed - as I will end up in lot of trouble if the process gets delayed for another 3 months. Is there any place where I can know exactly how INS determines the receipt date?

About I-693 - the main form (both in my case and my wife's case) is alright - it's the supplemental form to I-693 which shows the immunization record - under the results the doctor has checked "Applicant may be eligible for blanket waiver as indicated above" out of the 4 choices - The remaining 3 are - 1) Applicant will request an individual waiver based on religious convictions. 2) Vaccine history complete for each vaccine, all requirements met. 3) Appplicant does not meet immunization requirements. The Waiver requested from INS for some vaccinations are based upon "Insufficient time interval" incase where Dose 2 is required after 2 months and for other vaccinations it's marked as "Not appropriate age". So based on these facts do i need to worry about getting another medical checkup (for both me and my spouse) or should this be sufficient as per INS requirements?

You won't need to get another full check-up.
The INS has extended the validity of the medicals. Technically it's a year but for the last few years it's been extened. That may change but I doubt it.If the INS determines something is missed they will issue a RFE just for whats needed. I would wait for the RFE so that the required paperwork goes to them and also it will then go to the right place and not get left in general mail for who knows how long.
Also the applications are stamped when physically received. NOT when they are opened.

I am still not clear about one thing though - Like I specified earlier that because of June 30th deadline I had to submit my wife's 1-485, 1-131 & I-765 Applications without the medical reports (I-693). Now I have got her medical done - but she has to take "Dose 2" of MMR Vaccine which is due in next month. But the Doctor told me that I can submit the reports without "Dose 2" and later submit "Appendix A" to I-693 once I get her "Dose 2" done. Now as I have'nt submitted her medical reports to INS - should I just wait for an RFE at a later date or should I just go ahead and submit the medical reports that Doctor has given me and later submit "Appendix A" once I get her "Dose 2" done. Which of these ways will be the safest and fastest?

Submit the paper work when you get an RFE for it.

AGain the RFE.

I never submitted any medicals at all until the RFE. CHeck my signature for approvals afterwards. It didn't take that long for me or my spouse.

Please suggest.
