I have a Bachelors degree and had fours years experience when i had applied my GC . My PD is June 1999.
But my I140 was approved in EB-2.
Subsequently i applied for 485 in November 1999. My FP is scheduled in March.
I was reading some postings here, where some guys put their views , saying that when approving the 485 all the details are validated carefully.
So my concern is that will the IIO say that this case should not have been a EB-2 case, so close the file and approve it only when the dates become current or simply see that the I140 was approved in EB-2 and proceed from there.
What do you guys think ? Should i be concerned ?

Anybody with a similar experience ? Any way to solve this puzzle?

Any suggestions/advice greatly appreciated .

Thanks!.

Princeofpersia: What is the cause of your concern?Yes I have seen cases posted on this board where they dug out the whole LC file out during 485 processing. That is if they find some conflicts, and I remember that case was also EB3->EB2( he converted from EB3 to EB2). They do that and do they do it on each and every case or file I dont know, I have a feeling they look for some patterns which forces the INS to probe, they definetley look at the I140

Thanks Chutney !!!

You are talking about a case where the candidate or the candidate\'s lawyer converted a EB-3 case to EB-2 ( i hope i am reading you right)

My concern is that my lawyer applied for EB-3. But my I140 got approved with EB-2.
My LC show that i have a BE degree with four years of experince.
So will my I 485 be processed as a EB-2 or EB3????
I am worried that if my case was processed as a EB-3 then i will have to wait for another generation.
Will the IIO see the I-140 and justify the EB-2 approval or will point out the error and suspend processing till my PD becomes current

The most important concern is the time and the whole waiting game !!!

Princeofpersia: To be honest your case is on the border line for EB-2 you need a Masters degree (3 years experience) or a Bachelor \'s Degree with 5 years. If the adjucating officer that is assigned to your case is lienent then he/she might overlook some of this, because apparently you have more than 5 years of experience now, you can always suggest that and make a case.

There is nothing you can do right now, just plan for the worst, worrying will not help you just remember you will always be approved its just a matter of time.

I dont want to sound like I am pessimistic but those are the facts as it seems.
