I am on H1B and my wife just got her H4 i-539 approved. The comapny that I work for is a seasonal business but the office is open the whole year. Since there are no H1Bs left we know that she won't be able to start working until October of 2007. My company would like to sponsor her an H2B visa so she could start working in May and then switch to H1B. Everything seems simple but... I'm afraid that her COS from H4 to H2B will not be in place before we have to start applying for her H1B. Let's say that the day on approval for H2B would May1st. That means that until then she is H4 but we want to send her H1B application in early April to get in line before the quota runs out. That means that she will have to put on the H1B application that she is an H4 but her H2B will be in process by then or maybe approved, who knows? What do we do in this situation. Is her H1B application going to be a COS from H4 to H1B or from H2B to H1B? Can somebody help please!!!!!
