Rfe :Received my ins APr 2004.

FBI Name check :Spouse cleared - Dec 2002
Self :Reply from FBI :USCIS never initiated for me.

Today talked to a person at Emg'y.was very polite and helpful.
She said everything about our cases looks good but your name check is not cleared.I told here about FBI inquiry , she searched and said your's is being scheduled.Sometimes this may happen , for some reason they did not schedule mine.

This is very very frusrating and shows these people will work however they want.With 2004 cases being approved in 3-4 months , why are they playing with our lives.

Look at the bright side!

Since 80% of name checks are cleared within 3 days and 97% are cleared within 120 days, as soon as CSC initiate your name check, you will have pretty high chances to be approved very fast.

It could be worse if your name check was pending with fbi for years like for many other people.

You had FP2 done already and still not happy! You are asking for too much luck!
 
I would suggest you to initiate a senatorial enquiry, this should help your case. contact your local senator. when the senator enquiry is sent out, USCIS has to open your file and reply to the senatory. Take a chance.. cost you nothing! it helps infact

Where do you get those statistics? I have seen people waiting for years for Name check to be cleared with FBI. I have read posts on this forum that even when FBI's name check returns a "no record", it may take them months, and sometimes years, to send the results back to USCIS.

I am seriously confused.
 
the numbers are approximate because don't remember exac ones. also the statistic is about visa name checks, but fbi never mentioned any difference between name checks for CIS and for State Department. The numbers are from "Testimony of Robert J. Garrity, Jr., Acting Assistant Director, Records Management Division, FBI

For Senators, see www.senate.gov

For House Reps, see www.house.gov

In each of these you can see who your Senator or US House Rep is against your ZIP code.

I have not been able to get a fingerprint even after writing to both CA senators (both responded virtually with the same stuff that we see online, the usual "60 days" etc message). I have recently contacted the House Rep for my area and his office seemed to be more pro-active - said " we will find out where it is stuck".
And all this even after FBI had cleared name check nearly 2 years back.

My name check is pending for more than 2 years now.

NO THEORY WORKS !! Every body is second guessing...

You will be approved when you will be approved.

we are all making wild guesses.. Those guys out there in INS give different answers all teh time.
 
I agree with sfbay_area_guy..
I am planning to wait for few more months...else will try AC140 route for Consular Processing...that means another few grand expenses and travel/medical exams..headache.
I am not sure whether you can get stuck in name check in CP also or not? any comments?
