Hi! I need some inputs regarding my case. I have a lawyer working with me but I think he is not knowledgeable enuf with regards to my case. I have removal proceedings and my master hearing would be next year. I was put into removal proceedings because my husband made a police report, I was arrested for assault 4th degree. The charge against me has been dropped, but I was transferred to Ice because I overstayed my visa, the reason I was put in removal proceedings. I'm now separated with my husband, and I have a protection order against him, I was granted protection order because of the incidents from the past that he hit me physically. My lawyer told me I can't apply for I-360 because I have a removal proceedings at the immigration, I should apply vawa cancellation instead, and I have to wait for my master hearing. He told me I can't apply for I-485, I-765 yet. I'm not sure if my lawyer is advising me that this is the best thing to do, because he can't really explain to me what he should do with my case. My husband is asking for reconcilliation, but I'm having doubts of going back to him, because there's no assurance that he is a change man already. I still love my husband but this love is not enuf to change or forget what he did to me from the past. I have an approved I-130, that's the only paper that my husband had filed for me.Your opinion is much appreciated. Thank you!
