Hello Friends,
I recently got my GC last month and upon the receipt I have gone back to India, can any one tell me
1) when will I have to come back to US so that I maintain the status for GC , and what is the maximum time I can stay in India without a re-entry permission.
2) Did I had to fill an re-entry form b4 coming to india ?
3) Will there be any problems for the same and I have take my social nos and my GC with me before leaving to India.

Thanks in advance.

Regards,
Sam

Re-Entry Permit
Lawful Permanent Residents (green card holders) use re-entry permits to re-enter the U.S. after travel of one year or more. For LPR’s returning to the U.S., re-entry permits are generally valid for two years from the date of issuance of the re-entry permit. The LPR should apply for this benefit before leaving the U.S.

Please note that a re-entry permit does not guarantee admission into the U.S. Aliens with re-entry permits are still subject to the inspection process at the port of entry. It is also important to note that travel outside of the U.S for more than one year will under most circumstances break the continuous residence requirement for later naturalization purposes. Travel for over 6 months may break the continuous residence requirement. See Section 316 (b) of the Immigration and Nationality Act.

From this what I understand is that if you are out of the country for over a year you loose the rights for residence but if you return back within one year then you are safe and all your rights are intact !!!!!
Correct me if you think I am wrong.

Regards,
Sam

Any trip abroad must be temporary in nature, and you must maintain proveable ties to the US to facilitate your return (bank accounts, credit cards, an address in the USA, etc.) These days, it is very easy for the POE inspectors to determine how long you have been absent from the country, and the burden of proof is on you that you have not abandoned your US Permanent Residency. I have a friend whose mother (GC Holder) moved back to her home country after getting her GC, and she was denied entry when attempting to return. She had been absent more than one year, and did not possess a re-entry permit.

I think the burden of proof is on USCIS if your trip is less than 6 months. For greater than 6 months it's on you. Some sites/forums even say that's it's always on USCIS.
