Validity of the spouse status

Is spouse status legal?

Hi everyone! Anyone help on this issue would be appreciated very much.
Ashimila got the employment authorization approval after he applied the asylum. But the case has been pending for two years. The old visa of he and his wife already were invalidity. Is his wife'status illegal residential when the case is still pending? His wife has not employment authorization approval.

Lynoman,
As long as your asylum case is pending you can keep on applying for Employment Authrization Documents until they make a final decision on the case. Unless they deny your case you are not illegal. As long as you applied for asylum within one year of your arrival in USA, you should be fine.
