Valid H1 till Feb 2004. AP not applied, working on H1, What is the risk?

Hi Guys,

I have a valid H1 stammped on passport till Feb 2004. working on H1 and not on EAD. I did not apply for AP.

My mother is seriously ill, I have to start to India in a day or two.
No time to apply for AP now. Cannot go to Local office since, I changed address with INS after recieveing EAD and FP.

What risk am I taking while re-entry?
For safety, I am also carrying tax-filing, pay-stubs along. Is there anything else I need to carry?

Also carry a current employment letter, and copies of your H1 approval and I485 receipt. Produce only documents that are asked for.

I was asked for H1 documentation, and I showed my approval letter and an employement letter. I also had copies of my LCA and my H1 application but did not produce these.

You should be fine (as long as you are still with the employer whose name appears on your H1 visa!).
