I have a question regarding my H1B. I'm currently on a H1B which is valida until Aug 2006. But if I count the number of years I have worked, my 6 years on H1 will be complete in Aug 2005. What are my options?
I was applying my GC through my previous employer, had my I140 approved, I was just about to apply for my I485 when I got laid off. I requested the company to help pursue my GC process, but they didn't want to do that. So, I had to change to a H4 status at that time. I stayed in H4 status for about 2 years and completed my MBA. Then I had another employer sponsor a new H1B. This H1B is valid until Aug 206, but my 6 years will be complete in Aug 2005. What options do I have? Do I have to leave the country or change back to another status again?
We are currently applying our GC through my husband, who is a PHD holder and works for the National Lab. So, we are applying through the National Interest Waiver category (EB1). This is a faster process, so we are hoping to get our EAD sooner. But I'm not sure if it will come through before Aug. What should I do?
