Valid EAD/AP ... I94 expiring in July Please help

Hi Guys,

I'm sure if you were in this situation at any point of time in your process, you would certainly know what should be done.

My details are as follows

RD: 11/27/01
ND: 11/29/01
AD: Waiting
EAD / AP Valid till Dec 93

Now, the date on my I94 expires in July, I'm really wondering if I need to revalidate my I94. I asked legal associate in my company, she has an opinion that when your 485 is pending and you have a valid EAD / AP then you don't need to worry about the I94. Even if the date on I94 is expired BCIS does not care about it.

But, lately I had seen some postings on this site where people expressed a different opinion.

Please help, if you know something about this situation.

I guess you mean Dec 2003.

No Body has to revalidate the I-94, you get it new each time when you land here. You should not worry about I-94 as long as you have valid EAD and AP. Do you have your extended H1?

You can stay here as long as your adjustment of status (I-485)case is pending here. Be sure to renew EAD before Dec if you are on EAD now.
 
Yes, it is Dec 03.

The EAD that I carry right now is the 2nd one, first one expired in Dec 02.

Good to know that you share the thoughts as my company's legal associate, that as long as I have I 485 processing going on I don't need to worry about date on I 94. I can continue to work on EAD and live on AP.
