Hi all,
My LC was filed under PERM in Sep 2005 and approved in Nov 2005. I-140 under EB-2 was filed in Mar 2006 and still pending. Now I want to simultaneously file under EB-1 since retrogression date for that category as of May 2006 Visa Bulletin is July 2005. Can I use PD of Sep 2005 from EB-2 and concurrently file I-140 and I-485 once dates reach the same (hopefully next month). Just like EB-2 I am planning to file EB-1 with the university that employs me.
