Using EAD....what happens to H1?

Hi,

Till last week, I was on H1-B visa with visa stamp of employer X in passport uptil May 2005 .
Now I changed companies and joined employer B using EAD.

I do have AP also till April 2005.

What will happen to my H1 visa ?

Can I go out of US and enter on H1 stamp( till stamp is valid) issued by previous employer? or do I have to use AP to enter?

By using EAD did you mean you signed the I9 form with the new company.

Your H1 is not longer valid because you changed your employer. The only way to keep it valid is do a H1 transfer.

I think you must use your AP at POE so that your status will change to Parolee, i am pretty sure your H1 is invalid now since you are no longer with the company.
 
Yeah I signed I-9.

But the visa stamp is valid and prev employer is not revoking H1.

Is there any rule /memo for this?
 
The basic concept of H1 is that you stick with your sponsor. I am not sure where in the books this is, but i think thats the general idea. (You are brought into the country to do that job because they could not find suitable skills in US.)

If you quit the employer who filed your H1, your h1 is not longer valid.

I would suggest you to use AP while travelling.... to avoid problems later, consult your attorney before travelling.
