Company A did my green card processing. My 140 is approved and My I485 is pending for 2 yrs. As company A went out of business, I moved to Company B on EAD. I am planning to travel to India next month using Advance parole. I have valid AP until Sep 2006. I haven't filed AC-21 yet. I was told by my lawyer to file it,only if there was an RFE from INS regarding I485. My H1-B has expired.So i have 2 questions.
1. Can i travel to india and safely return back to U.S without any immigration problems at the port of entry?
2. Do I need to file AC-21 as soon as possible or I can i wait.?
