Using AC21 while CP

Hi:

Has anybody used AC21 portability while doing consular processing?

I was laid off before 180 days while doing AOS in US. After that I worked for a new employer for a few months using EAD before moving to Canada as PR. This new employer is willing to offer me a job again. According to a prominent lawyer, I can use AC21 even in CP provided I have a similar job offer.

Any suggestions? If possible, how to notify NVC about change of petitioner?

I am not a lawyer...

But I would think that you need atleast a new I 140. You may even have to start from scratch if you interprete the LC rules by the letter- because the LC is employer, job and location specific. If your lawyer is confident and you trust him, good luck. I don't think AC21 applies to CP.
 
Take appropriate legal advise in this matter. The following are just my thoughts:

My understanding is AC21 is only applicable for AOS cases. With CP you are expected to keep your job atleast till you attend your
interview at the consulate.

Good luck to you if the work around as suggested by your Attorney works. Post any details for the benefit of other members.
