According to Aug 21, 2003 BCIS memo.
This is my conclusion
1. If your I-140 is approved AND
2. 180 days have passed since the RECEIPT DATE of I-485
You can change your job and work for new employer on EAD
provided the new job is similar.
My question is what does it mean by similar job description
Is it
A> Same job title as the one on labor. ( section 9 of ETA-750A)
OR/AND
B> the new job description should be same as that was described
on LC. (section 13 of ETA-750A).
I meet conditions 1 and 2 and have EAD. My current duties are different than what is on LC.
The labor was filed in Nov 2000. Since then I acquired diff skills
My client wishes to hire me and was asking me about the GC status.
Legally I can change the job but I would not have same title
and job description.
What should I do?
If they really want to hire me I will explain the situation and will
only accept if
1. they give Same or more salary
2. Give me a letter in the way I want it if BCIS asks for it.
Any suggessions. Any similar experiences. Do clients hesitate
to agree on these terms?
