Use of AC21 & Job in different state

hmmmmm

Registered Users (C)
Here is the scenario.

My I140/485 ND is Mar. 2004.
I140 is approved in Aug 2004. So now it is even > 180 days after I140 approval.
My Labor was filed from IL as that was our company headquarters that time. But I NEVER lived in IL.

I would like to switch the jobs because by the new rule of PD, it will take quite some time to reach my PD (May 2003). Now I have 2 questions:

1. Do I need to find a job in IL bcaz my Labor was applied thru IL? Is it allowed to find job in any state while using AC21?
2. If it is allowed and I change the job and move to some other state, what are the chances of getting my case transferred to local office?

In short, is it advisable to move between states while using AC21?

Thanks in advance for your feedback.

>> no u can work anywhere in USA using AC-21

2. If it is allowed and I change the job and move to some other state, what are the chances of getting my case transferred to local office?
>> nobody can't predict about any chances of case getting transferred to local office.
even if it gets transferred its not a big deal.

But if someone takes up a new job (using ac21) in a very far off location (say, hmmmmm takes up a job in Hawaii) wouldn't the case be automatically transferred to a local office there? Otherwise, traveling back and forth (for FP etc) would be big pain in the rear.

Another Question

Thank you fast GC Seeker for your advice.

I will be changing job usine H1B transfer. Now here is a million dollar question.

Is it advisable to file AC-21 after changing job?
Or
Can I just change my job on H1B and if the RFE comes then file AC-21?

Best judgement will be appreciated.

Use h-1B or AC-21 not both

You will be using H-1B or AC-21. I believe you cannot use both as they are two different statuses. If you are using H-1B then what is the need to send a letter stating that you are taking advantage of AC-21. Even if you use AC-21 its not necessary you inform INS about it. You can inform them if they send a RFE or for interview or when you are sending them some documents next time around.

Hope this helps.

This is my opinion not advice, use it at your own risk.
