Hi Gurus,
I filed for 140/485 concurrently and now, the sponsoring company wants to stop payroll. I am in H1 status now and now I wanted to file a H1 transfer. My laywer suggests me to wait till March 2004 to file for a H1 transfer because he does not want me to apply before I complete my 6 months with the sponsoring compny.
Since I cant stay with my sponsoring company for 6 months ( which will be in Feb 2004), he suggests me filing for a H1 transfer but not use it immediately. He suggested me using EAD till mar end and then using the H1 petition to start working. Is this possible?
Can I file for a H1 transfer now, but work with EAD till Mar and then shift to H1?
If H1 transfer is not possible, can I apply for a new H1 visa now and start working from Mar 2004? Till then I will be using EAD.
