I have visited this forum several times but this is my first post.
I am waiting for my 485 approval. I filed my 485 in the first week of Feb, 2002 and had my FP in April, 2002. I have received my EAD and AP.
My question.
My H1 expires in May 2004 after 6 years. Eventhough I have EAD, I have not used it. I am planning to travel to India sometime in the first few months of next year, 2004. Is there any specific advantage of maintaining my H1 status or Is it ok to use my AP to enter US?
Maintaining US involves extending my H1 after May2004 and also go through the hassle of applying visa in US cosulate in India.(It is more than one year since my last visa stamp expired).
Given the delay in the 485 process, I am not sure whether I will have my GC in the next few months.
Please give me your advice/thoughts.
