Use AP or H1/H4

Hello...

I am planning to go visit europe for 15 days sometime next month. But will be back by end of september 2004. My H1 and my wife's H4 is valid until November 4th, 2004 (completing 6th year). We got our EAD & AP which is valid till Jan 2005. My wife started working partime (3hrs a week to get started) for the past 2 weeks. But my wife requested her employer not to run payroll for another 3-4 months. My question is can we go to europe and come back using our H1/H4 or do we need to use AP when we come back. My employer is going to file my 7th year extension. This is FYI.

Your help and advice is greatly appreciated.

--Yes, U can come back on H1/H4.

--U dont need AP to come back ,Since u r h1 / H4 is valid and since u r wife is not working Officially(using EAD without payroll)

Thanks for your reply. How exactly did USCIS know whether one is in EAD or H4? Is there any document which we need to submit to USCIS once anyone starts working in EAD?
