Two USCIS workers went to visit my in-laws, left their numbers and asked my mother-in-law to call my wife and give her their number and asked that my wife call them asap. When she called they asked to meet her at a restaurant and they had something very important to tell her. When we went to the restaurant, they said that they didn’t wanna talk to me – they only wanted talk to my wife. They had about four letters with them and they claimed that my wife wrote those asking them to withdraw her petition. In one of the letters it’s stated that my wife wants to move on with her life and wants nothing to do with me again; they didn’t let her read the remaining letters. They said nobody could’ve written those but my wife as they include some personal info that only she would know. All these claims are nothing but LIES. They also claimed that we were living in the same apartment complex but in different units and the landlord had told them that we didn’t live together. Again, lie. The last apt complex we lived has more than 200 units and the landlord knows nobody personally! They also said that she was having her school letters sent to her mom’s address and that she put on her school application that she is single- another lie lol. They claim to get this info from the school officials. After she confronted them and told them that they were lying, they assured her that my application will be denied and we should expect a denial letter soon. When she asked why aren’t they coming to our residence to see if we’re really living together instead of going to her parents, they said they don’t know our new address and she pointed out the address they had in front of her and said that this is our new address and they were like oh we didn’t know you guys had moved lol…. They said many other things and there were too many contradictions. She said she couldn’t help but laugh at some of their claims.

Our attorney said that they cannot deny it because they still do not have enough proof; if they did, they would’ve done so three years ago. They seem to be looking for an easy way out – they just want my wife to withdraw so they can deny it. I think the way they’re going about it it’s pretty stupid. At first they attempted to convince her to withdraw her petition, that didn’t work. Then they tried threatening her, that was also useless. Now they’re making up lies just so she can withdraw.

Is it normal for gov’t officials to make up such lies? If we’re not allowed to lie to them, why are they lying to us? This is ridiculous!

A little info about my case: 3 yrs ago we went to our interview and they told us that my brother-in-law had told them during his naturalization interview that my wife was living with her mom – not with me. So they suspected fraud. They did this after our lawyer threatened them with a lawsuit.

It's common for cops, FBI, and other law enforcement to lie to a suspect during interrogation, in order to trick them into confessing or giving up valuable information ... "we found your fingerprints on the weapon ... we found your DNA at the crime scene ... your brother says he saw you do it".

Have you filed a WOM lawsuit yet? Is your wife a US citizen who filed for you? Or is it vice versa?
 
No, the lawsuit was not filed yet. The attorney gave them a month to respond before she files it but they came up with these stories exactly two days after the deadline. Now I'm just waiting to receive my EAD before filing it.
My wife is a US citizen who filed for me and they want her to withdraw her I-130 petition.

Did your wife see the letters which they claimed to have from her? Did you verify their identification and wrote it down, including badge ID?
 
They only showed her one letter and refused to let her see the remaining. It was two of them; one did all the talking while the other one was just listening, studying my wife and nodding his head (as if he was agreeing with my wife). The one that kept talking gave my mother-in-law his business card and even his cellphone number. When we told our attorney his name, she recognized him immidiately. They had our original AOS application and the passport pictures that we submitted with. We didn't get to write down their badge ID or anything but I'm sure they're USCIS employees. They even mentioned the email our attorney had sent them regarding the lawsuit.

Why wait for the EAD? File the WOM now so your case goes under supervision of the court. Without court supervision, they still feel free to jerk you around without consequence.
 
I'm waiting for the EAD because my current one has just expired and the new one was lost in the mail so I had to reapply again. I need it to renew my DL. I'm afraid if I file the lawsuit now and they deny the case, I won't be able to drive till the whole appeal process is taken care of which could take a year or two, who knows, I just wanna be able to get my DL now.

So when we file the lawsuit, is the court going to supervise the case and they can't just deny it without convincing the court?? Or they can just deny it based on the evidence they already have which is not strong enough for denial?

Once you've filed it, they have to convince the court if they want to deny your case. So if you're worried about denial based on their dubious evidence, file WOM ASAP so they can't deny you without the court's permission.
