04/16/2007: Advisory for FY 2008 H-1B Cap Filers

* Some of the filers on April 2 and April 3, 2007 have received more than one Receipt Notices. Close reading of the notices will indicate that one was issued and dated prior to the running of lottery machine on 04/12/2007 and the other one has a different date. USCIS has notified the AILA that the one which was issued early on or right after 04/02/2007 has been invalidated and those cases which have been selected in the lottery have been issued another Receipt Notice. Accordingly, if you received a second notice, it should mean that your cases have been selected in the lottery. The first Receipt Notice should be ignored or keep it as a souvenior! Who knows, there may be someone who is willing to pay tons of money for this historical record of H-1B cap reaching in one day?


4/16/2007: USCIS Brushes Aside the Rumor of Multiple H-1B Cap Filing by the Employers for the Same Employees

* There was a wild rumor running in the nation that in anticipation of the reach of the FY 2008 H-1B filing on the first day, there were some employers who had sent into multiple identical applications to the USCIS on April 2, 2007 to win in the lottery, contributing indeed to the reach of the cap on the first day. However, the USCIS has confirmed that their record reflected that this rumor had not been substantiated by internal checking of filings. This report probably means two things. Firstly, it is a relief that the integrity of the immigration filing has not been compromised by the consumers. Secondly and more importantly, it also means that the needs for the professional foreign workers have reached the level of extreme crisis and unless the Congress acts quickly on the legal immigration reforms as reflected in most of the past and present immigration reform bills, including STRIVE Act, SKIL Act, High-Tech Relief Act, and upcoming CIR, the nation's businesses will indeed suffer tremendously. There has already been a rumor going around that more and more people are under the threat of potential lay-offs and the nation may be heading towards the economic recession. It is time for the politicians and nation's policy makers to stop playing politics and work for the welfare of the people and nation.
