USCIS response time after RFE CSC

Can anybody give me an idea how long it takes once I-140 RFE is responded to. USCIS asked for evaluation of credentials. Have PHd from UK which was evaluated by World Educational Services in 1999 (for H1-b). This was in the initial application - so I don't know why they asked for it again. Attorney replied with the same documents plus some documentation from WES website to say who they are.

Is it possible to get more than one RFE. ie was the first RFE just for eligibilty for EB2 advanced qualification and would it be possible to get further RFE on the 3 prongs NIW?

Hope you can help? I've posted a couple of questions over the months but nobody has ever replied :confused: maybe they are dumb questions!

It took over 3 months for them to reply to my RFE (also PhD, also WES). It took 2 1/2 months for the RFE response to reach an adjudicator's desk according to information from an emergency line call I made. I ended up wasting money on a new EAD card application for nothing. :mad:

On the bright side, I have seen many RFEs on this board take 2 weeks to process from receipt, so the 1 month estimate is reasonable.

I haven't seen any statistics on 2nd RFEs. It is always possible but I have found that the first RFE will tend to ask for all the information on a given petition.

For instance, I had an RFE on my I-140 that asked for 2 things and an RFE on my daughter's I-485 that asked for three things.

My feeling is that 2nd RFEs tend to arise from not replying correctly the first time. I sense that what you are trying to determine is if your NIW claim has passed :)

You're right that whats i'm getting at. I'm just a bit confused as to why they asked for the info since its already there. My attorney just replied with the same, so I'm hoping they weren't looking for additional info. I read somewhere that you should have a full evaluation done, but mine just says US Equivalency is earned doctorate (PhD).

Its not uncommon for them to ask for the information already submitted and / or ask questions that could easily be answered with the originally submitted evidence. On these forums, I have seen people responding and saying "What you are asking for was already submitted" (in possibly an angry tone) and some other people explaining the same evidence in more detail (in a polite way). I have also seen approvals and denials after both kinds of responses.

Based on my personal experience, you should read the RFE letter yourself and see if there is anything hidden “under the usual sentences”. When I received an RFE on EB1-EA, my lawyer was not happy and told me that “looks like they didn’t even read the petition letter. If you have some additional evidence, provide it to me otherwise I will just reply with the original letter”. But when I read it myself, I was able to understand what they were asking for. I wrote a response answering their questions using already submitted evidence (attached again for reference) and also added a few new evidences. The petition was approved quickly after they received the response.

I read the RFE and understood it to be the same info but in addition they wanted info about the evaluator (in my case World Education Services). My attorney replied politely stating the information had been included in the application but provided it again along with info from WES website and a written statement of my qualifications. Hope this is enough :eek:
 
Yes it is possible to receive a second RFE. I got it twice on two seperate 140 applications. In both cases, the second REF was on a different part of the application. Timeframe for responding to RFEs vary. I'd say on average about 6 weeks. If it takes more than 6 weeks and you don't receive a denial (or another RFE), I would take it as a good sign. :rolleyes:

Could you please share some info about your RFE? How do you responde to it?I recentlt got my RFE for I140-EB1-EA. They simply say that the original evidence is not enough to make a favorable case and they want additional evidence, but didn't specify what?

In my RFE, they said exactly that (original evidence not enough and they need additional evidence) and listed all ten (actually 9, all except 'display of work in artistic......') criteria on the RFE letter. They also added a line or two (kind of hidden) in each criteria that I claimed raising a very specific concern (i.e. We believe that the awards presented are academic as they were earned while the alien was pursuing his or her education. Please provide evidence of awards earned after completing education).
 
Its hard to define the days they take. In my case, the case was approved the with in couple of days after USCIS received the RFE response.
