USCIS Published Rule Removing Limitation for Period for EAD

The USCIS published this desirable rule today. This removes the limitation for the USCIS to issue EAD for one-year validity period. Consequently, the USCIS is allowed to issue EAD for period longer or shorter than the one-year EAD which the immigration community is familiar with. The USCIS determine the validity period of EAD each time a new EAD is applied, or a renewal EAD is applied, or a replacement EAD is applied on the basis of the following standards:
Immigration status of the applicant
General processing time for underlying application or petition
Required background checks and response times for background checks by other agencies
Other security considerations or factors.
Where a political asylum is granted by the immigration court, USCIS will issue the EAD valid upto five (5) years.
This rule is effective today.

any idea if this rule will apply to the existing applications they are currently reviewing?
 
my EAD was approved today, the online message changed this morning. I hope they will issue my EAD for at least two years. I suppose I'll just have to wait and see what comes in the mail. :)

My 2nd EAD got approved on 7/28 and I received the card today (8/02). Its valid for one year only. I am not sure if yours will be valid for longer than a year because you got approved on 7/30, after the memo was out. Goodluck.
 
Received the card on Monday Aug 2nd, valid for just one year! Lokks like I missed a longer EAD by one day. If TSC continue to speed up I may have my I-485 approval by the time it expires in July 2005 :eek:

It was mentioned in the document: about EAd's extension.

Similarly, BCIS intends to issue EADs to asylees with a validity period
of five years, unless otherwise appropriate.

An expiration date on the
card reflects only that the card must be renewed, not that the bearer's
work authorization has expired.


--does it mean we can work even with expried EAD's/ it it is true it is very good for us.

Since BSCIS will start issue EADS for the validity shorter or longer than one year judged by individual case. Dose it mean the shorter EAD validity people get, the sooner their I-485 will be approved?

Supposedly -yes.

But this what I think ... they won't issue it for less than a year -- that's basically like putting themselves on the line.

They may want to play it safe and issue EADs for 2yrs for EB/485 pending folks.

The problem with less than 1 yr, folks would really get upset if their 485 does not adjudicated by then....plus everyone is used to the 1yr deal now.

Gotta wait and see the general trend .... my EAD should be here in a week - so I would know if there is any change.
