I went to USA on August 16, 2016 to apply for a I-131 application for a Re-entrty permit.
I ended up stayin in USA until February 16, 2017 because USCIS lost my 1-131 application. Originally, I forgot to submit the $85 biometric fee when I submitted my I-131 application in mid August, 2016. So I immediately sent them a $85 money order which they received on September 7, 2016. However, I never heard from them. So I called them in mid late September, 2016 only to find out that they couldn't locate my application, because I did not have access to my case ID#.
I finally located my case ID# in January 2017 and I called them and told them I had sent out the $85 Biometrics fee in September. It turns out that they shipped my Bioemetrics appointment notification to the wrong address! So I gave them my correct address.
Yet, they still haven't addressed the issue, even though I mailed them two separate written requests in January 2017. Now I have returned to my home country. I could not stay in USA any longer. I stayed for 180+ days in USA.
In my two separate written requests which they asked for in January 2017, I stated that 1) I had in fact submitted a Money Order for the $85 Biometrics fee in September 2016. 2) That since I already completed a Biometrics appointment in November 2016 for a separate 1-90 application issue, that I be waived from having to undergo another Biometrics appointment for my I-131. I even called them and spoke to an agent about this twice in January 2017! I even asked them to expedite my case.
The reason I went in for a biometrics appointment in November 2016 was because they made an error on my physical Green Card and said I was female. I am male.
I do not know why they are so incompetent?
What can I do now? My account on the USCIS website still says they are waiting for the $85 Biometrics fee. It is totally frustrating. Every time I address a problem and think it has been corrected, they continue to blunder about and don't fix it. There's always a snag.
I'd be grateful for any advice you could offer me.
Thank you
