USCIS Kept me in dilema!!!!!

Folks,
Here is my case. I applied for 3rd EAD and AP reneval on 7th July 2005.
I got my AP approved on 18th August and I received a denial on my EAD on 22nd of August. Here is what the USCIS stated in the letter.

LIN 05 2XX XXXXX

This notice refers to your Application for Employment Authorization(Form I-765) file on July 07,2005 in which you are requesting employment based upon your filing of a pending application for adjustment of status to lawful permanent resident under Title 8, Code of Federal Regulations(8 CFR) 274a.12(c)(9). Upon consideration, it is ordered that the request be denied for the following reasons:

Title 8, Code of Federal Regulations(8 CFR) 274a.12(c)(9) states, in pertinent part:

Any alien who has filed an application for adjustment of status to lawful permanent resident pursuant to part 245 of this chapter may apply for employment authorization duirng the period that application is pendig.

A review of your record indicates that the application to register permanent residence or adjust status(I-485) you filed with this office has been approved.The form I-485 is therefore no longer pending with this service and you are ineligible for employment authorization under 274a.12(c)(9).

There is no appeal to this decision. Please note that aliens who are lawful permanent residents of the United States are authorized to engage in employment. Please refer ay question to your local USCIS office.


Does this mean my case hase been approved?. If that is the case they should send me the 485 approval and my passports.

Oops i forgot to mention i got 485 query in July'05 they asked me to send my original passports and I did send them. After this the above mentioned story happened.

Mine is EB2 - Sept. 03. I got my EAD (3rd) time approved yesterday. Does it mean that mine 485 won't get approved in this 10 days???????. Looking at your case EAD was denied because 485 is approved. This means that EAD & 485 are under same officer and he is aware of your 485 status....
I think now I have to spend dollars for next 1-2 years in this reneval processes and give finger prints every year. I still don't understand concept behind finger print getting expired. biometrics is understood, its just index finger and they varify you are same person. Then how come they need to do 3rd time???

unless it was approved 3 months back when numbers were available
 
There is certainly some confusion here, if you haven't received your approval notice as yet and this letter states that your case is approved then you must take action immediately.

The good news is that your case might've been approved otherwise there is no sense of such a letter. This letter clearly mentions that your 485 has been approved, and you can take USCIS to court if this information is incorrect, therefore USCIS will not commit such a blunder of stating that a case has been approved while it is not.

I would check my online status to ensure that the case is approved and call USCIS myself or via my lawyer to find out if 485 notices are mailed or not.

I know a friend of mine got a similar message for his pending AP application. Later he found out that it was sent in error by USCIS and they reopened his AP application.
