USCIS has erroneously classified my case as EB3?

Here is the background:
I had filed I-140 to nebraska and it got transferred to Texas (06/14/06).
The job requirements are Masters + 3 years experience.
My lawyer kept saying it was EB2.
I got my I-140 approval on July 5th. The lawyer got the approval notice a few days back and he says that USCIS has classified my case as EB3.
He says that USCIS has goofed up.

Is that possible or did my lawyer goof up somewhere?
Can anybody shed some light on this?
(Because I'm from INdia and my PD is July 2002, it matters a lot).

My own opinion that your attorney lies. They do such type of tricks to be sure in the approval. I think he filed your case as EB3 on purose
 
Get a copy of filed I-140 from your attorney.
It should mention what was filed in it whether EB-2/EB-3

My lawyer is now saying that he is going to refile the I-140 again, asking them to reclassify it under EB2.

Does anyone know anythihg about this?
What happens to the original approved I-140 in this case?
