Hi,

It took a long time to get my I-485 case approved. And before I got correct GC more problems, because of USCIS mistakes. Here are the details:

I received the physical card with an error ("Residance Since" Date is wrong). I contacted USCIS by phone and asked about this error. The answer is to file I-90 form and pay $70 and wait for fingerprints and photos and then after all this I will get new card. My questions are:

- Is this the right way of correcting a card??
- Samething they ask if you never received the card, is it correct (My spouse card never received)??
- Any similar experience, how much more time they need to give correct card??
- Meanwhile can I use this incorrect card??

Your answers and guidance will be highly appreciated. It looks never ending story.

Thanks

NO GURU here???

I did not get any response from anybody on this?? Just want to know if anybody know similar situation/experience??? Any guidance will be very helpful.

Thanks

My spouse is still waiting for them to send a notice to redo the fingerprints also.
We applied the end of July for a replacement card and we got the receipt notice. Don't know when we are supposed to get the Fingerprint notice. It's been just about a month now.
Also it's the same for never received the card or error on the card. You just pay the $70.00 Biometric fee.

helloman007,

What date are you expecting be in there on the card ? and what date actually written on the card..?

Actual and card dates

My I-485 was approved on May 05, 2005 and RESIDANCE SINCE date is July 15, 2005 (This is when they issue the card).

I checked with INS and they are saying this is an error. In their system it is May 05, 2005.

Take it easy and don't panic, You may consider to thanks to God that there is only small glitch they made, ppl shared they changed/switched photos on Husband/wife and dob msessed even signature.... name spell error....etc

It seems the issue is May to July..... 2/3 months diff,

There is simple procedure u need to follow if u do want to correct that,

Since the typo/error form USCIS side, they are not charging anything to u, there are many ppl shared that one of name I rememebr 'CuriousGeorge' and 'Wolfman' they had same issue and I believe they filed I-90 online and checked on the box on Fee-removal because mistake is done by USCIS.

If online doesn't have option about Res since then its better to Paper file with an attach letter and ur copy of approval and ur GC, asking them to correct that....... and honestly that paper filing will be the best option..... to explain whats wrong with ur card. so they can correct it.

so relax, take it easey, and goto online USCIS site or paper file the190 , no fee need to pay. carefull on your typo. thats all.... hopefully u will get within two month ur new card...................... Beee happyyyyyyyy :D

Good LUck

Prince of Jungle and Curious George you are not quite correct. You do not have to pay the application fee (185$) because it's their mistake BUT you have to pay for the Biometric fee all over again. 70 $. The application now says you don't pay for the application fee but all must now submit 70$ for Biometrics. I know: they just cashed mine and I am waiting for the appointment letter
Helloman007 did everything exactly as he sholuld have

Exceptions: There are three exceptions to having to pay the $185 application fee:
If you are filing only because when your card was issued it was incorrect due to a USCIS administrative error.
If you are filing only because you never received your card.
If you are filing only to register at age 14 years, and your existing card will not expire before your 16th birthday.
NOTE: All applicants, regardless of age, are required to submit the $70 biometrics services fee.

http://uscis.gov/graphics/formsfee/forms/i-90.htm

Also you do NOT send in a letter etc explaining the mistake. YOU bring everything with you when you get an appointment letter for fingerprints again. At that time you bring everything you need to show what the mistake is and the proper documentation to prove the mistake is theirs. EX. If the name is wrong you must bring ID to prove it. Bring in marriage license, Birth Certificates, whatever documentation you need to prove the claim.
They will confiscate the Green Card with the mistake and you must wait all over again to receive the card after they redo your Biometrics.

Thanks for your time and help

First of all thanks so much for your time and help.

grunggy is correct, I read the forms and website of USCIS carefully and got similar answer from customer service center of USCIS that I have to pay $ 70 as Biometric fee. No need to pay processing fee of $ 185.

My concern is not fee BUT the time, aproximately 3-6 more months. VSC is currently processing I-90 of May 05. Since I don't have anyother option I will do what the law says.

Thanks a lot again.

Damn. They have changed the rules since I did my I-90 in Dec 04. I guess they realized that its costing them too much to make mistakes, so the cost should go back to the innocent applicant.
