Hello All,
Check the following URL for the update from USCIS on the backlog elimination update. They are mentioning most of the cases are processed within 5months. They also include a standard disclaimer on the security check. I dont understand why USCIS cannot charge an additional fee and request one more background check (like some requests are mentioned in the thread that FBI never received). I hope by October 1, 2006 my IL will come.

I believe that their definition of a case "in their control" is pretty narrow. In my case, they mis-routed my file (right before my scheduled interview last May) and completely ignored me until my Senator's office got them to schedule an interview (13 months and 4 days after my priority date).

I never had any FBI or FP or Name check problems -- the problem was an internal USCIS file transfer issue.

Oh well

Cases outside our control, and therefore, not counted in the net backlog include: cases that are pending law enforcement security checks

I havent got a reply from FBI yet according to FOIA. Its been 3 months.

No idea who else is doing background check other than FBI

my timeline
--------------
Applied: June 2005,
Fingerprint: Dec 2005
Interview: Feb 2006 (Albany)-passed. nothing was written on my n652.
May 2006: made an address change because of a mistake in my application that I made (They moved my file to NY Fed Plaza); still background check pending
Sept 14: went to Fed Plaza: reply: Security Clearence
------------------
8 months. is there any end to this?. I am under "out of control" category and I am going out of control. There is a limit to patience. I didnt do any crime. I have a predy decent name.

what do u think I should do next week? a law suit?(on what basis?)

any ideas?

Why don't you sue? You've waited the 120 days... time to do it and get on with your life!

Good luck!

Move your butt and sue them...everything u need
