USC Spouse and I have different addresses

Hi All,

I am getting married early next month in US to a USC. I am preparing to file for Green Card right after the marriage, as I am currently on H1-B.

My questions are listed below; i would appreciate any help -

1. I live in a different city and my wife to be lives in a different city. We won't be living at the same address until middle of Oct. Can we have different addresses on all the forms; while I apply for the green card (I-130, I-485 etc.).
2. Also, I already went ahead and did my medical (I-693), that also has my current address, where as my wife to be (sponsor) will have a different address on I-130. Hope that's fine?
3. Since we won't be living together until Oct; only proofs that we can submit until then are marriage certificate, joint back account statement. will that be enough? We won't have joint lease until Oct.
4. Also, since I have a job and my wife will have job. Do I need to fill I-864 and I-864a to show my income? Or my wife's income will do? She makes above poverty line specified for 2008.

Given that you are trying to prove the legitimacy of your marriage to the USCIS, I would imagine that it would be best to wait until you are at the same address to file and can send a joint lease, joint utilities, joint financial statements, etc.

1. I believe you can list different addresses on the forms. Your biometrics and interview will be scheduled based on your address. You should definitely mention your plans to move in a cover letter.
2. Same as above
3. While I can't predict the USCIS's behavior, if I were looking at evidence of a marriage and only saw a marriage certificate and one joint bank account statement, I would issue an RFE due to insufficient evidence.
Other documents you could use to prove a relationship include: joint health/vision/dental insurance policies, joint car insurance policies, documents showing you are each other's beneficiaries for life insurance, 401k plan and investments, joint health club membership, affidavits from friends and family, photos over a period of time, e-mails or letters over the course of your relationship
4. If your wife makes the amount required, you do not need to show your income.

I would strongly recommend having a complete, strong application rather than rushing to put together something that could be seen as insufficient (and therefore delaying the overall process.)

I agree, why rush it?
Wait until october and file all the forms under the same address. By then you'll be able to gather more evidence as well.
The address on the I-693 doesn't really matter, since the medical is valid for 1 year it could have been done before you got married and got your own place together :)
You're on H1-B so you don't risk anything waiting until october. It's only a couple of months away anyway.
 
Sounds good to me guys; I will wait until we move in together to file the paperwork.
