My wife is expecting to be come a USC this year. What I would like to know if she could sponsor me once she becomes a USC? I have heard that naturalized citizens have to be in that status for a few years before they can sponsor their spouses. Is that true?

Thanks,

Copper

Copper Congrats. The day she receives her naturalisation certificate (after oath) she will have to fill out form I-130 and you send in the following forms:-copy of naturalisation certificate, I-485, I-765(work authorisation), Advance parole(if you are planning to travel; 864-Affidavit of support by your wife) and in some instances medical exam- depending on district office. They have moved the center to a chicago box office in some states for sending these applications. Some states (like oregon) can send in these to the local DO until 1st of April after which they need to be sent to Chicago. sO SEND THESE IN AS SOON AS SHE IS NATURALISED- DONT HAVE TO WAIT.

sORRY ONE MORE THING. The only instance she cannot sponsor you would be if she got her citizenship through marraige to another USC,,,SHE WOULD HAVE TO WAIT 5 YEARS,

Hmm, where did you get that from? I don't recall ever seeing such a rule. Any link?
I back that. No such law that you need to wait 5 years if spouse became USC thru previous marriage.

if ur spouse has not filed any tax returns till now and if she started to work just six months earlier can she be the sponsor.

OK...I am still new here but have learnt a lot from everyone especially JoeF.
I was wrong...the period of 5 years is if a permanent resident is sponsoring an alien relative: I-130 form Section 3.E.(1) TO (3)

I also live in the states with an Asylee status and I make a few hundred more than poverty level, will my spouse still need to show that she can support me? Currently I have a pending I485 that will probably take another few years.

Thanks,
