US Visa Validity when applying candian PR - Help please...

Gurus,

I have seen some where in the Buffalo tracker that applicant should have atleast 1 year of valid visa at the date of application. I am planning to apply by July 2005 and currently on my 6th year H1B that expires by April 2006. Am I still eligible to apply for the Canadian PR under Skilled worker catagory?

Please advise.

The deal is that you can apply at Buffalo is your were ADMITTED to the US for 1 year, which you were. Your problem will be if you apply at Buffalo, and you need a US visa to return for an interview if necessary. If you don't need a visitior visa then apply to Buffalo, but if you do require a visa, you are better off applying in your home country. You should note that Buffalo will not transfer files.

Hi PMM,

Thank you for your response. However, I still have question that you may please clarify. I will be able to get 7th year and 8th year H1B extensions in US based on my pending GC process. I am also planning to get H1B visa stamping on my passport when I get 7th year H1 extension from either Canada or from India. If an Interview is required means that would be in any of the US posts of Canadian Immigration offices, right? In that case do I need a Canadian Visitor Visa? And during the Interview if they ask for my status in US, Is it enough if I produce the Original I797 H1 Extension approvals to them to prove my status?
