I know this is the wrong forum but I think some of you have experienced this and would appreciate an answer.

My friend's wife is working in US on H1B... My friend wants to visit her for holidays. Should he apply for visitor visa or H4 ? I know H4 visa chances are better. But should it be a problem since he is planning to go back after the holidays?

Best regards

H4 is a no mess visa...

He should apply for H4 visa. It is a no mess visa and he can keep visiting US back and forth till the visa expires. Infact they might give him trouble with the visitor visa due to immigration intent since H1 B is a dual intent visa so since his wife is a candidate for immigration how can he not be.

In my view, the consulate guys will be confused why your friend wants a hassle of visitor visa application if he has a option of a dual intent H4 visa.

will_get_there, raminator,

Thanks for the reponse. Just to clarify, since my friend is planning to go back home after the holidays, would that be a issue at the interview?

This one is a no brainer. H-4 is safe, use as directed!!! :)

No issues...

I don't think there can be any issues if the person wants to go back to his home country even after coming in on H4. Ask him not to mention this to the visa officer during the interview...

Rule is don't volunteer the info. Just tell what they ask. Mostlikely they won't ask how long does he plan to stay here since H4 is for 6 years, so don't jump up and say I want to go there as a visitor.

I-134

Will_get_there,
Thanks for the info;
Does some one who is applying for H-4 needs to get an I-134 affidavit of support?
