I got my GC (PR) on 02/19/02 when i am eligible to apply for US Citizenship? Do I have to wait for the completion of 5 yrs?

In the meantime, my office has opened an office in India and would like to transfer me there within next 3 months. I was wondering what should i do especially since i have sacrified 9+ yrs being here right from the H1B status to PR.

If anyone, has been in a similar situation and has proven success please write back.

Thank You,
DT

you can apply US Citizenship 90 days prior 5 yrs you complete your GC PROVIDED you also fulfill all the necessary requirements.

pls review the N400 Guide line for what kind of "necessary requirements" they are.

it is an interesting statement of what you said

"i have sacrified 9+ yrs being here right from the H1B status to PR."

I wonder if you did not really like staying here since US provided you H1B status, and you received your PR, and now you could be able to apply citizenship. sacrify seems a strong word.

anyhow, none of my husiness and good luck

Once you remain out of Usa continueously more then six month you loose your chance to apply for us citizenship. that mean you will loose almost 4 years. Friend wait one more year and get usc.

You can apply within 90 prior to the 5 years aniversary. If you want to go back to India, you can go, but you won't accumulate time for your Citizenship and if you stay too long...you may loose your GC too.
On the other hand, the way you put it, why should you sacrifice one day more, just go on with your life and forget about Naturalization. In my understanding you don't want to become a real American, you just want to grab that valuable document (Naturalization Certificate)

For those of you who provided information on this thread. I am very thankful.

it is sad to hear people trying to gauge the fact that my USC is just an opportunist. I dont think anyone should try to challenge other's opinion or choice of USC.

The reason of posting this thread is to ascertain the facts since some i recieved conflicting statements that INS was allowing people in their 5th yr of PR to apply for USC.

If the choice is getting USC and being American that we all should be proud, but at the same time we should not demoralise others with our comments.

Thank You

God Bless!

You came to live in America, not that America invited you to stay here. You have to sacrifice whatever it takes if you intend to stay here. From the very first day you came on H1-B, you are eligible to apply for GC. Why it took 9 years for you is nothing INS can do about it. It's their policies and procedures. You have to live with it like others.

There is no other way for employment based GC holders, but to wait 5 years minus 90 days to be eligible to apply for citizenship. You can't apply even single day before.

If you want to stay prolonged times out of USA, you will be jeopardizing the chances of becoming a citizen. Read the rules. If your company insist you of staying in India, you have to make a choice. Citizenship or your company job.

If your company insists and you want to become a citizen, say goodbye to your company. It's not the only one.
