I am a US citizen by birth that recently married a Mexican national who is in the U.S. on an F1 visa, currently attending an undergraduate program. We would like to know what forms we need to go through to get her a work permit and a green card. Following is a list of USCIS forms, and I would like to know if these are all the forms we need to fill:

I-130
I-485
I-864
I-765
I-693
I-131
G-325

Regards,
Juan

You do not NEED to file I131 or I765. I765 is an application for a work permit if the person would like to work before receiving the GC. (useful if the GC takes too long) I131 is for advanced parole (permission to travel before receiving the GC).

Also note that I693 is provided and filled out by the doctor in a sealed envelope, which you provide with the application forms.

You specifically need G325A(consisting of 4 pages), and you need 1 for you and one for your spouse. (i.e. 8 pages in total).

Otherwise the list of basic forms look fine. I dont know which I864 form you are providing ---- you have some options. (see instructions for the various versions, depending on your financial situation). Do you meet the financial requirements to sponsor? If not, you may need a co-sponsor to complete another I864, in addition to yours.

Also remember to send all the supporting documents/photos requested by each of these forms. Read the instructions CAREFULLY.

Best wishes.

There is no need to file two for the spouse ---- one G325A for the OP(4 pages) and one G325A for the spouse(4 pages).

2 for the spouse is correct. 1 G-325 for I-485(spouse only) and another for I-130 (husband and spouse).

I see where you have deduced that from ---- a strict reading of the forms may lead someone to believe that. In fact, this is not necessary. The I485 and I130 is "cross-referenced" - while both forms ask for it, you need only submit it once.

Good to know then. I couldn't find any information about "cross-referenced" in the instruction, so I submitted two anyway. Not a big deal printing another copy.

No, I agree - you did the right thing. If there is doubt, rather follow the more cautious method. The extra form won't hurt. I just wanted to clarify the matter.

Where have you been before I filed my application??? :) I only wasted paper and printer ink :)

But well, it's always better to overdo, if you're not sure :)
