Urgetnt! H-1 Visa Stamp

Hello Friends,
My brother just got his H-1 approved but since he was out of status for a littl while, his lawyer has advised him to go to India(COO) to get the visa stamp as the I-94 was not included with the I-797. Questions are:
Should his company pay for his air-tickets?

We are from U.P. which falls under the New Delhi Jurisdiction, but his lawyer entered Bombay and his H-1 approval notice indicates he get his visa stamp from Bombay consulate.

I quote""If you have H1B approval, you need to stamp your passport for H1B VISA at the consulate mentioned in your H1B approval."

Would Bombay consulate ask him to go to New Delhi for the visa or can he get it from Bombay consulate since it is already indicated on his I-797?

Hmmmm.....

Interesting situation.

The Mumbai consulate website (http://www.visa-services.com) does mention that you need to be resident in their jurisdictional area, or you need to have obtained your last US visa from there. Since the first is not true, is the 2nd case applicable?

As such, one can always apply with a local address - just to prove "residence in jurisdiction"; however, there is one logistical problem. The passport is usually returned by courier after 2/3 days (definitely for drop box cases, and even for interviews I believe - not sure though) to the local address that you indicate on the form. Which means that you need to park someplace in Mumbai for that period....and putting a hotel address is probably not the wisest thing to do ;-)
