My situation is a little complicated. My I-140 is approved and H1 (6 yr) is expiring in mid february, 2002. Just applied for the 7th year extension and AOS. I have not applied for AP yet. I am planing to travel to India within the next 5-6 months to get married. I understand that I have two ways to do that - first, wait for H1 approval, travel with H1 to get marries, get spouse with H4 and apply for AOS; second, apply for AP without waiting for H1 apporval, travel with AP and then include spouse\'s name again in another 1-485.
In the first case, I am not sure if 7th year H1 extension will be approved. And even if it is approved, I don\'t know how long it takes to be approved. If it takes more than 4 months, I might not get enough time to add spouse before the approval of AOS.
In the second case, I am not sure if spouse will get GC at the same time of AOS approval. Is it true that spouse can also do CP in India if applied before AOS is approved?
