urgent !!!

I have been laid off n my H1 has been cancelled in january2002. I found an employer who is filing a new H1 in this week. Will this H1 gets approved..?? Before how many days i should file this H1 after being laid off.Can i legally stay here if i get the receipt no. in this week..?? Can i hv the option of changing to F1 if this H1 is not approved without leaving this country.

You should talk to the company lawyer about this.
