Hey guys
Have any one travel outside the country, before AP was approved and come back after you receive new AP.
Here is my spouse case. We applied on AP renewal on Sept 4th, issue a RFE(marriage cert) on Nov 4th, satisfied on Nov 11th, Still waiting for approval. Her grand mother is sick and she have to go to India, Local INS will not give emergency AP, as CSC has already issue a RFE(Kinda stupid, but...) CSC can't expedite the process as grand mother is not immediate relative and it seems they have back logs in their mailing room and officer has not yet received the RFE document, which was sent by overnight mail(This are words of duty officer in CSC).
As this is the emergency scenario, I was THINKING what we will leave outside the country with current AP and I will back before our first AP expires and once I get her new AP, I will send it to India, so that she can come back.
So my question is Has any one took the risk of leaving the country and then coming back with approved AP, which will be mail to them in India? Do they cross verify at POE, when you left the country and when was your AP approved? Or do they add a entry some where while leaving outside the country that you have a AP plus the expiry date? Is there a huge risk that my spouse will not allow to enter?

Rule is that you should travel with AP

I think the rule is that while leaving you have to carry your AP along with you.

I do not know if they cross verify the dates, but last time when I was entering USA on AP, the officer asked me if I had got the AP before I left USA. I replied in affirmative and then I do not know what he did inside the room.

I remember reading that there is written that you should apply for min 2 months ahead of travel date. If you did so , you shouldn't be flouting any regulations.
 
Detail Experience.

I have entered twice using AP. Both the times I was asked to go to secondary inspection.

Officer colleted AP and passports and went inside to do some verifications (I guess!! I was waiting in lobby).

In the first encounter I got I-94 stamped with date as indefinite AOS pending.

Second encounter I got I -94 stamped till the validity of my AP. I read some where that this has been recent practice in INS to stamp till validity of AP, It does not mean though that you will go out of status if you get a new AP or stay here till your application has been approved. As long as you are AOS pending status you are in Valid status.

Both the time officer asked me if AP was with me when I was travelling abroad.

At POE .. every thing was normal.. yeah Secondary Inspection was new, but all it added was few steps and 15- 20 minutes of Wait.
 
AP is must

Please do not take risk travel without AP unless you have valid H1 in passport.

when your AP is pending travelling is risk.
 
Hey guys,
One more question.My wife's AP is approved but we yet haven't received it in mail.Is it okay to fly with the old AP and when the approved one comes maybe i can mail to her and she can come back.Ur inputs will be greatly appreciated as she is flying this week.

You can call INS and request them to send it thro FeDEx, I don't know if CSC will entertain that but do remeber somebody requesting this at INS VSC and the IIO talked with his/her supervisor, later got the credit card number of the caller and mailed the AP notice thru FedEx overnight.
 
We are planning to travel outside the country next week. We have AP valid unitil March 2003. Do we have to renew AP before we travel? If we do not renew AP before travelling, after we come back by using current AP, do we have to renew AP to keep the status?
