Hi,


My friend who has a valid H1B Visa stamped till july 2004
from company A which brought him here for 5 months project
when he went back to his country he switched his company and went to Germany by company B ....now my friend wants to travel to USA from Germany for a week on his OLD H1b Visa.... is it possible?(H1b have not been cancelled by previous Company)

If he is not intending to work in the US for an H-1 employer he should not enter on an H-1 visa.

Should he enter the US in H status, he will be subject to detention and removal during his stay here since he will not be employed by an H-1 sponsor. If he is asked a question regarding his employment during the entry and he does not tell the truth, he will have committed immigration fraud and that could have long term repercussions.
