I am married to a USC for a couple months now, and I havent filed for residency yet... I was wondering if I am allowed to get a drivers license since i havent filed for my residency!
 
Depends on what immigration status you hold before you got married. Just marrying an USC does not give you any benefits, only the right to apply for those immigration benefits and then (specially after you get a SSN) you can reap the rest.

so, in short, depends on whether you had a legal (non visitor) status before and have maintained it.
 
I was on F-1 student visa, which i believed I maintained until i got married and stopped attending classes.. If i fell out of status, must be after i got married. I just want to know if i can still get a drivers license before i file... although Im gonna file in a months time anyway!
 
Merely getting married to a USC does not cancel your F-1 status* or grant you any other status. But if you stop attending classes**, that would end your status. If the DMV of your state verifies immigration status with USCIS, and the school reported your absence to USCIS (which they are supposed to do since the SEVIS implementation), the DMV would reject your application for a license after hearing from USCIS.


*[size=-2]Although you don't lose F-1 status by marrying a USC, you may have problems trying to use the F-1 visa to reenter the US after overseas travel.

**Attending classes in the summer break is optional for F-1 students, so if you attended school the entire previous semester, and have not graduated or otherwise terminated your enrollment, deciding to avoid summer classes would not harm your F-1 status[/size].
